Citizenship Verification
Unless exempted from verification or pursuant to federal law, no state agency or political subdivision of the State of Nebraska shall provide public benefits to a person not lawfully present in the United States. The Nebraska Department of Banking and Finance is required to verify the immigration status of all individuals registering with the Department as agents and/or investment adviser representatives. The Securities Act of Nebraska and implementing rules require broker-dealers and investment advisers to verify citizenship and immigration status and maintain a copy of the completed United States Citizenship Attestation Form for each registered person. The firm must also submit the completed attestation form and supporting documentation to the Department for individuals identified as qualified legal aliens.
Verification of citizenship and immigration status is due upon receipt of the initial notification letter. Failure to verify citizenship or immigration status and submit required supporting documentation within sixty days will result in the Department taking administrative action to terminate the registration of the agent and/or investment adviser representative.
Online Portal
The Department has changed how it will notify firms and receive information relating to the citizenship verification process. Broker-dealers and investment advisers who must verify the citizenship and immigration status of its registered persons will be able to submit information and documentation through a new Online Portal (https://ecmp.nebraska.gov/ndbf-qla).

Online Portal Process

Firm receives notification from the Department and receives a Temporary User Name

Firm accesses portal at: https://ecmp.nebraska.gov/ndbf-qla

Using the Firm CRD Number and the Temporary User Name, the firm accesses the portal.

Firm reviews and confirms the status of each agent and/or investment adviser representative registered on behalf of the firm.

Firm provides required explanation and/or uploads required supporting documentation, as needed.

Firm completes its attestation and submits the roster to the Department.

No further action is required by the firm unless contacted by the Department.
